Action against Eureka Park proposals

Further to our news item of 21 June (below), there is growing opposition to the published plans for the Eureka Park development, which are seriously at odds with the Site Policy in the Local Plan. The Kent Messenger (Ashford edition) carried the story on its front page on Thursday and we have written the following letter to the editor for publication in this week’s edition:

Like so many organisations and residents, the Sandyhurst Lane Residents Association cooperated with, and on occasions fought, ABC and its officers to produce the adopted Local Plan 2030 which, when finally adopted, we thought would set the shape of the borough for the next 10 years.

We were wrong!

Developers apparently can flagrantly and arrogantly propose new layouts for the already agreed site concept of Eureka Park with more houses, less commercial space and a new 150 bed retirement village, with less green space. To reduce the impact of this increase on the local transport system they then propose to completely overturn the Local Plan S20 Policy which clearly states that “Vehicular access to the site shall be provided from Trinity Road only”. Contrary to this Policy we now learn it is proposed that 150 of the new houses shall exclusively use a newly created access point onto the rural Sandyhurst Lane.

Is it disingenuous to suggest that the developers would not have made the investment necessary to get this far in the Planning process without a “nod and a wink” that such a reversal would be considered permissible?

Eureka Park development

The adopted Ashford Local Plan 2030 includes provision for the development of Site S20, Eureka Park, which directly backs on to Sandyhurst Lane. The development proposed in the Plan is for a mix of commercial (about 20 hectares) and residential development (indicative capacity of 375 dwellings). During the formative stages of the Local Plan, the SLRA successfully lobbied for the inclusion of two conditions designed to protect our rural environment.

Consequently, the Plan includes the requirement that:

“Development proposals for the site shall include the following elements:
…. A generous landscaped buffer to residential properties along Sandyhurst Lane
…. Vehicular access to the site shall be provided from Trinity Road only”


In April, the developers (Quadrant Eureka LLP) submitted to Ashford Borough Council a “Scoping Opinion” application, which is a request to the Council to ask whether or not any future planning application needs to include an Environmental Impact Assessment when/if it is submitted or the scope of any future assessment. It is not a planning application and the Council does not consider the planning merits of the proposal at this stage. The result of the application has just been announced and, not surprisingly an Environmental Impact Assessment will be required.

Whilst this is not a planning application, the documents submitted by the applicant necessarily outline the broad details of the proposed development. In particular, the Scoping Report, which may be viewed here, states that:

he Proposed Development will seek permission for:
- Residential development of between 400-600 dwellings;
- A c.130-150 bed retirement village;
- A c.5ha business park;
- C.11ha of open space;
- Retention of the existing lakes;
- Pedestrian and cycle routes;
- Primary access from Trinity Road using existing vehicular accesses;
- Secondary access to a single residential parcel of the development (c.150 dwellings) (no through road) from Sandyhurst Lane;
- Sustainable urban drainage systems; and
- Associated infrastructure and other works as necessary.

We have highlighted issues of particular concern which directly contradict the requirements of the Ashford Local Plan. The proposals indicate that planning application will seek to reduce the commercial development from 20 to 5 hectares and increase the number of dwellings from 375 to 400-600, plus a 130-150 bed retirement village. Furthermore, it will seek to allow access to 150 dwellings direct from Sandyhurst Lane. The indicative map in Appendix II of the Scoping Report shows that the proposed access would be in the vicinity of public footpath AU3 where it emerges into Sandyhurst Lane (exactly where the speed limit changes from 30 to 40 mph).

The Scoping Report includes further detail on page 8, as follows:

A new vehicular access into the site is proposed from Sandyhurst Lane to serve c.150 dwellings. This will not be a through road for vehicles into or out of the rest of
the site but will nonetheless increase vehicle traffic on a rural road. This has the potential to affect highway safety along Sandyhurst Lane, pedestrian and cyclist
safety and key junctions between Sandyhurst Lane and the A20 in addition to the Sandyhurst Lane and A251 Faversham Road junction. The Transport Assessment
will therefore need to assess the effect on Sandyhurst Lane by virtue of provision of a new access junction.

SLRA responds to amended planning application for the Sand Pit,
Sandyhurst Lane


The SLRA has submitted detailed objection comments for the amended outline planning application for 9 dwellings at the Sand pit to the south of 200 and east of 198 Sandyhurst Lane (see news item 27 May 2020). The comments, which represent the views of the overwhelming majority of members, are a revised and updated version of our previous objection comments submitted on 13 November 2018.

SLRA recommends traffic speed control measures

The SLRA has written to both parish councils with responsibilities for Sandyhurst Lane (Westwell and Boughton Aluph & Eastwell) with recommendations for measures to manage traffic speed in Sandyhurst Lane. This initiative is designed to feed into the Parish Highways Improvement Plans being developed in conjunction with Kent County Council Highways.

The recommendations were developed by the SLRA committee after detailed consideration of traffic speed issues which have been of concern to members for many years and taking account of traffic speed surveys which have revealed widespread disregard of the speed limits, in particular the 30mph speed limit.

SLRA raises problems of flooding and herbicide drift with Eastwell Park Estate

Following complaints from members living in Sandyhurst Lane about flooding and herbicide drift, allegedly from the farmland opposite their homes, the SLRA wrote in January to the land owner, seeking a constructive response to deal with these issues. After a follow-up letter in April, we eventually received a response in May.

The SLRA committee has considered the response and concluded that it was not very helpful. It was therefore agreed, at our virtual committee meeting on 3 June 2020, to publish the correspondence on this website and also to copy it to Westwell Parish Council, which is already aware of the issues.

Sandpit planning application amended from 18 to 9 dwellings

Amended plans have recently been submitted for the outline planning application for the Sand Pit to the South of 200 and east of 198 Sandyhurst Lane. A copy of the letter received from Ashford Borough Council may be viewed here.

Members may recall that an outline planning application (number 17/01636/AS) was submitted on 26 October 2017 for 18 dwellings on the Sand pit to the south of 200 and east of 198 Sandyhurst Lane. This was eventually withdrawn by the applicant in June 2018.

The application was then re-submitted on 19 October 2018 as number 18/01554/AS, with exactly the same description as previously, namely:

Outline planning application with details of access and layout provided for developer-led custom-build residential development of up to 18 dwellings, open space and landscaping, wildlife habitat reserve, new access to Sandyhurst Lane, parking, engineering (including ground modelling) works and infrastructure, with appearance, landscaping and scale reserved for future determination.

The SLRA has submitted detailed objection comments to this application and many members submitted their own objection comments. The SLRA comments, which represented the views of the overwhelming majority of members, were based upon a survey carried out for the previous, almost identical application. A check was made with members to ensure that the survey results were still applicable to the new application. The SLRA response may be viewed here.

Since then the application has remained undetermined. The amended plans which have now been submitted are open for comment until 17 June 2020.

The description of the application has now been amended to:

Outline planning application with details of access for developer-led custom-build residential development of up to 9 dwellings, open space and landscaping, wildlife habitat reserve, new access to Sandyhurst Lane, parking, engineering (including ground modelling) works and infrastructure, with appearance, landscaping, layout and scale reserved for future determination.- ALSO INCLUDES AMENDED DESCRIPTION
(Highlighting indicates changes)

The main amendment, as reflected in this description, is the reduction in the number of dwellings from 18 to 9. The Planning Statement includes the following:

… the description of the proposed development subject of the planning application is to be amended to reflect a reduction in the number of proposed dwellings from 18 to 9 dwellings. In addition it is proposed that the outline planning application will now only consider site access details, with all other matters including layout which although a matter previously to be determined as part of the outline planning application to be reserved for subsequent approval.

The SLRA will be considering the amendments which have now been submitted for this application and will make a further response if appropriate. The application may be viewed here (search for application number 18/01554/AS).

Tip bookings open today

Further to our news item of 6 May (below), KCC have confirmed that their Waste & Recycling Centres will open on Friday and that, from 11am today, a new online booking system will open for people wanting to visit. People can book a slot either online

at www.kent.gov.uk/hwrcbook or

by phone on 03000 417373.

Four time slots are available each day between 9am and 3pm to allow social distancing:

   - 9am to 10:30am
   - 10:45am to 12pm
   - 12:15pm to 1pm
   - 1:45pm to 3pm.

Once bookings are complete, a reference number will be sent to you via email which you must take with you.

Each household will be restricted to just one trip each month to ensure everyone can use the site safely.

SLRA has tried to test the online booking system as soon as it opened. On the third attempt we managed to get into a queue with over 6,500 others in front of us!

Tip to re-open on 15 May

The KCC Waste and Recycling Centre will re-open in a closely managed way on 15 May. Only one booked visit every four weeks will be allowed and strict rules will be in place.

The following details have just been posted on KCC’s website:

From next Friday, Kent County Council’s Household Waste Recycling Centres (HWRCs) will open to the public for essential use.

On Wednesday, May 13, people will be able to book a slot to use one of the county’s 18 HWRCs which closed on March 23 as a result of the Covid-19 lockdown.
People can book a slot either online or by phone for the opening on Friday, May 15 – details on how to book will be released next week.

KCC Cabinet Member for Environment Susan Carey said: “I know how valued our waste and recycling sites are to the people of Kent and I am immeasurably proud of the work our waste team has put in to getting these sites reopened.

“The booking system, which was developed by Medway Council, is crucial to ensure we can keep visitor numbers at a level where social distancing can be maintained and minimise queuing.
“Our focus over the last few weeks has been in ensuring kerbside collections provided by district and borough councils continued, and our teams were redeployed to support those crews.
“Kerbside collections across Kent are now all, or about to be, fully reinstated by the districts and boroughs, including garden waste services.”
The sites will be open to the public between 9am and 3pm to allow for enhanced cleaning.
Most sites will be open seven days a week and will accept all types of waste including chargeable items.
Susan added: “Government advice is that residents should continue temporarily storing their waste at home, if they can do so in a way that doesn’t pose a risk to their health.
“If, however, waste and recycling cannot be stored at home without causing risk of injury, health or harm, please book a trip to your local HWRC.”

Residents can only book one trip in any four-week period to allow all residents to have access to sites and must follow social distancing guidelines.

Social distancing proved impossible to maintain prior to closure as visitor numbers topped 800 visits a day.
KCC operates 18 HWRCs, providing facilities for the recycling and disposal of more than 30 different types of waste.

Booking

Visitors to the site will be limited to help us manage social distancing. The number of bookings for each site will vary depending on the size of each site.

You can only access the sites by booking an appointment. The quickest way to book is online.
You can only book one trip in any four-week period. This is to enable all residents to. have fair access to our sites.

If you want to drive a restricted vehicle to a Kent council site you’ll still need to apply for a vehicle voucher. https://www.kent.gov.uk/waste-planning-and-land/rubbish-and-recycling/vehicle-restrictions-and-vouchers. Restricted vehicles are not allowed to tow a trailer.
Bookings will only be accepted from residents in Kent/Medway.

You should not try to book a visit if you have symptoms of Covid-19, if you are part of a household undertaking 14-day isolation or if you someone who is in the shielded category.

Arriving at the site

If you booked online you must bring your proof of booking email, either a printed copy or displayed on your phone. If you booked over the phone, bring the booking reference number we gave you when you made your booking. To reduce infection risk your car windows should remain closed when showing proof to staff.
You must attend the site within your booking slot. If you miss your slot, you may not be allowed to use the site. We suggest you stagger your entry times within your booked slot, as we are expecting a high demand for the service.

Social distancing and safety

You will need to observe the social distancing measures when visiting the sites. Site staff will not be able to offer their usual assistance to help unload and dispose of waste.

A maximum of two people can leave each vehicle to dispose of bulky items without site staff help. However, if you do not have bulky items to dispose of, only one person can leave the vehicle to dispose of waste.
Traffic management will be in place at all sites. Some sites may also block off every other parking bay so that customers and staff can keep to social distancing guidelines. Site staff will direct you.

You will not be allowed onto the compactor platforms when a member of staff is operating the machines.
You will need to follow site guidance, and this may include wearing gloves and masks. If you wear either gloves or masks, you’ll need to take them home for disposal to avoid the risk of cross contamination.
We ask that visitors to the HWRCs are patient as we all get used to this new way of using the sites. The restrictions are in place for everyone’s protection. If you do not follow site rules you may be asked to leave the site. Security will be in place at the sites. Please be aware that site security includes Automatic Number Plate Recognition, CCTV and body-worn cameras.

The site may need to close temporarily for cleaning with no warning.

If you need to dispose of waste contaminated with coronavirus this should be carried out at kerbside. If this is not possible then you need to double bag the material and store this securely for 72 hours before bringing it to the site.

M20 re-surfacing slips by a year

The SLRA has been campaigning for many years to have the M20 between junctions 8 and 9 re-surfaced with "quiet" tarmac. With the help of our MP, Damian Green, in 2017 we extracted a commitment by Highways England to include these works in their budgeted plans for 2021/22.

Since then we have continued to take every opportunity to keep the pressure on. Most recently, Damian Green wrote again to the Highways Agency seeking assurances that the works were still programmed. The reply, received today, shows that they are, but that the timescale has slipped by one year; the re-surfacing is now scheduled for 2022/23.

This is perhaps not too surprising, given the present Covid-19 lockdown and the extreme economic pressures which will result. Nevertheless, we shall continue to press for this work at every opportunity.

Speeding traffic in Sandyhurst Lane
















The Covid-19 lockdown means that there is much less traffic on the roads. It also means that individuals and families in our area are taking their daily local exercise in Sandyhurst Lane and the surrounding area. This has resulted in complaints that the quiet roads are encouraging some drivers to speed along the Lane and endanger those who are using the Lane for exercise.

Because of its relatively good safety record, we have yet to persuade KCC to consider speed management measures in the Lane, though our efforts continue. Meanwhile in the current emergency, thanks to SLRA committee member John Hobbs, Director of Medash Signs Ltd, signs will be erected tomorrow at each end of Sandyhurst Lane, calling on drivers to slow down and reminding them that families are exercising in the Lane.

Planning permission granted for extension and car port at Cumberland,
Westwell Lane


Planning permission was granted on 14 April 2020 for the erection of a first floor extension & car port to the front of Cumberland, Westwell Lane including works to create a driveway (part retrospective). Full details may be viewed here (search for case number 20/00203/AS).


Several objections had been made by local residents and Westwell Parish Council, with particular reference to the proposed car port. The conditions attached to the permission includes the following:

The area shown on the approved "proposed ground floor plan & front garden/driveway layout" plan as vehicle parking space/driveway and car port shall be retained for the use of the occupiers of, and visitors to, the development, and no permanent development, whether or not permitted by the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking and re-enacting that Order), shall be carried out on that area of land so shown or in such a position as to preclude vehicular access to this reserved parking space.

Bus passes

Kent County Council has this morning announced that older and disabled bus passes can now be used before 9.30am.

The full details on their website are as follows:

Older and disabled people will be able to use their bus passes before 9.30am, Kent County Council has announced. The passes will be able to be used on services provided by Stagecoach, Arriva, Go Coach, Redroute Buses and Nu-Venture.

Holders of a senior citizen and disabled bus pass were previously able to travel for free on buses after 9.30am, but following discussions with these operators, this condition has been removed.

KCC Cabinet Member for Highways and Transport Michael Payne said: “I’m very grateful to Stagecoach, Arriva, Go Coach and Nu-Venture who have worked with Kent Highways and Transport to extend the use of the bus pass on their services before 9.30am. “This is something that will be extremely helpful during a time when some shops are opening early specifically for the older generation to support them during the ongoing coronavirus pandemic. “Our public transport team is working hard to extend this to other operators in the coming days. “This change will come into force tomorrow morning (Thursday) and I’m very happy that we have been able to support those in our community during this period of disruption.”

Kent County Council has a statutory duty to provide passes for free bus travel throughout England for older and disabled people under the English National Concessionary Travel Scheme (ENCTS). Over 250,000 people in the county have a bus pass, with around 227,000 for older people and 22,000 for disabled people.

Permission refused to fell protected trees

ontrary to the published decision of 2 March 2020 (see news item of 3 March 2020 below), which appears to have been published in error, Ashford Borough Council has now published a decision to refuse the application to fell three larch trees which are subject to a Tree Preservation Order at Crossways, Maidstone Road. SLRA AGM postponed

I

n view of the coronavirus issue, the SLRA committee has decided to postpone the Annual General Meeting, which was to be held at Sandyacres on 25 March. Whilst we are probably taking an over-cautious course of action, we believe it is a responsible one in the current circumstances, given the logistics of making the necessary arrangements for the meeting. We hope to re-schedule the AGM in the Autumn.

Advance notice of closure of Sandyhurst Lane

Yet again, contractors for South East Water are planning to dig up Sandyhurst Lane and this will necessitate closure of the Lane to through traffic, in the region of number 148, from 12 to 16 March 2020. Local access to the remainder of Sandyhurst Lane will continue from either direction up to where the road is actually closed. The alternative route for through traffic is via A20 Maidstone Road, Drovers Roundabout, Fougeres Way, Junction 9 Interchange, A251 Trinity Road and Faversham Road back to Sandyhurst Lane.

The closure is to enable repair works to be carried out following earlier excavations, being carried out by Clancy Docwra working with South East Water. Due to the nature of these works, it will not be possible to re-open the road outside the working hours. There is a slight chance that the works may over-run for unforeseen reasons such as adverse weather conditions or engineering difficulties.

M20 barrier to be removed

The steel barrier on the London bound carriageway between junctions 9 and 8 of the M20 is to be removed.

Work will start on Monday 13 January at 10 pm, when the entire M20 between junctions 9 and 7 will be closed overnight until 6 am on Tuesday. Subsequently, the London bound carriageway only will be closed overnight for 16 nights.

This means until 30 January, presumably unless the work is completed more quickly.

Advance notice of 10k run

The annual 10k run is scheduled to take place at 10.30 am on Sunday 2 February 2020.

As last year, the new organisers, Sporting Events UK, are holding the event based at the Towers School; it is no longer held at Sandyacres.

The published route (see here) shows that:

  - the race will start and finish in Lenacre Street, near the junction with Sandyhurst Lane
  - the whole of Lenacre Street and Kingsland Lane will be affected
  - access to Westwell village will be restricted
  - the race will NOT be routed along Sandyhurst Lane, but significant pedestrian traffic will be present
    particularly between Faversham Road and Lenacre Street

Last year, official KCC road closure notices were effective between 10.30 am and 12.30 pm.
